Today, ASMP filed a brief (see below) with the US Supreme Court in the case of Elliot McGucken v. Valnet, Inc. This important matter presents the issue of the “server test”, which is prevalent in the 9th Circuit. This test, in short, excuses certain types of infringements depending on what server the material resides.
The brief was authored by ASMP CEO Thomas Maddrey in conjunction with NPPA Counsel Mickey Osterreicher and Alicia Calzada. The brief received many signatories in the industry including APA, ASCRL, DMLA, PPA, and NANPA.
