“I run two businesses. One is a commercial practice that is primarily business to business/client direct. In addition, I make photographs for editorial use and do an occasional advertising assignment.

“The other business is my fine art practice in which I sell both limited edition prints and non-editioned prints.”

Fine Art Commission

“This was a commission that grew out of an opportunity to share my portfolio at an advertising agency when I was delivering a fine art print to an employee who is a patron. The art director commissioned the piece and had some input during the process. I found out in the middle of producing the piece that there were actually three people commissioning the work who would be sending checks. The three of their names appear on the invoice but not on the original proposal. The art director signed off on all the paperwork.”

Commission Proposal
Description Create a “Florilegium” style (photo collage) image featuring tuberose, hereinafter referred to as “Artwork”. Finished print size will be on 24″ x 30″ paper. Image size to be determined but will be as large as possible given proportions of final image to the paper size. Please choose one pricing choice by circling choice and initialing. All necessary materials to create Artwork are included in the final price.
Pricing Choices:
1. 24″x30″ original artwork no-edition (1/1 with one Artist Proof for personal portfolio)

2. 24″x30″ original artwork edition of 20 $1,500.00
A. An initial PDF proof of Artwork will be provided via email. Changes to this initial Artwork including a final PDF proof (2nd proof) are provided for in this proposal. We will proceed to the final print unless additional changes and PDF proofs are requested. We will charge an additional $150.00/hour (minimum $100.00 fee) for each change and proof beyond the original set of changes and proofs.

B. Upon acceptance of this Commission Proposal and prior to beginning the Artwork, a nonrefundable deposit of 1/3 is due, along with a signed copy of the Commission Proposal. An additional 1/3 will be due upon acceptance of proof for final Artwork. The final 1/3 payment is due prior to shipment of Artwork. Insurance and shipping to within 50 miles of greater Chicago is included in the price of this commission. The Purchaser is responsible for all applicable sales and transit taxes.

C. We will deliver the initial PDF proof of Artwork within ten days of the date of receipt of the initial down payment. We request that all changes be made within ten days from receipt of the initial proof. We will complete the Artwork within ten working days of receiving the Purchaser’s written approval on final proof and second payment along with any additional fees associated with extra changes and proofs.
D. The Purchaser may terminate this agreement if the initial proof is not to their liking and does not want to proceed to additional proofs and changes. The Artist shall keep all payments made and this Agreement shall terminate. In the event of termination of this Agreement the Artist shall retain all rights of ownership in the Artwork and shall have the right to complete, exhibit, and sell the Work if the Artist so chooses.

E. The Artist reserves all rights of reproduction and all copyrights in the Artwork, the preliminary design, and any incidental works made in the creation of the Artwork. No reproduction rights are granted in the purchase of the Artwork.

F. This Agreement constitutes the entire understanding between the parties. Its terms can be modified only by an instrument in writing signed by both parties.

G. A waiver of any breach of any of the provisions of this Agreement shall not be construed as a continuing waiver of other breaches of the same or other provisions hereof.

H. This Agreement shall be governed by the laws of the State of Michigan.
